Planning Permission/Approval

Before commencing construction on a plot, it is essential to obtain planning permission from the local authority. This ensures that the property complies with local zoning laws and building regulations.

Submit Application for Building Plan Approval

The property owner must submit an application along with the required documents, including the building plan, site plan, and structural details, to the local municipal or panchayat authority.

Documents Required

  • Application Form – Available from the local authority.

  • Ownership Documents – Proof of property ownership.

  • Detailed Building Plan – Approved by a licensed architect.

  • Encumbrance Certificate – Required if applicable.

  • No Objection Certificate (NOC) – From neighbors, if required.

Municipal Corporation/Local Authority Approval

The local planning authority reviews the application. If the property complies with building regulations, approval is granted, and a building permit is issued, allowing construction to commence.

Completion Certificate

After completing the construction, the builder or owner must apply for a Completion Certificate from the local authority to verify that the building has been constructed in accordance with the approved plans.

Plot Approval

For plots being developed for sale or commercial use, it is essential to ensure that the plot has the appropriate zoning and development approvals from the relevant authorities.

Sale Deed Preparation

Stamp Duty

The buyer is required to pay Stamp Duty based on the property’s market value. In Tamil Nadu, stamp duty is generally calculated at 7% of the market value of the property.

Registration

The Sale Deed must be registered with the local Sub-Registrar’s Office to ensure the legal transfer of ownership. Both the buyer and the seller are required to appear in person at the Sub-Registrar’s Office with valid identification and the signed Sale Deed for registration.

Encumbrance Certificate

After registration, an Encumbrance Certificate (EC) can be obtained from the Sub-Registrar’s Office. The EC provides a record of the property’s transaction history and verifies that it is free from any legal encumbrances.

Land Registration Expenses

  • Stamp Duty: 7% of the sale value or market value, whichever is higher.

  • Registration Fee: 1% of the sale value or market value, whichever is higher.

  • Other Expenses: Additional costs may include lawyer or document writer fees (if applicable) and charges for obtaining essential documents such as the Encumbrance Certificate (EC).
